TERMS & CONDITIONS
1. About these Terms
These Terms & Conditions (the “Terms”) form a binding agreement between you and ANANDA COMMERCIAL BORKER, an Abu Dhabi Trader establishment licensed under Licence No. CN-5366711 and trading as Ananda Hub (“Ananda Hub”, “we”, “us” or “our”). They govern your access to and use of the Ananda Hub mobile application, anandahub.com, booking tools, customer support and related services (together, the “Platform”).
Before creating an account or confirming a Booking, you must be given access to these Terms and the Privacy Policy and actively indicate acceptance. We may keep an electronic record of the accepted version, date, time, account and Booking. If you do not agree, do not create an account or make a Booking.
2. Definitions
| Term | Meaning |
|---|---|
| Booking | A request or confirmed reservation for a Partner Service through the Platform. |
| Customer / you | A person who browses, registers, books, pays for, receives or uses a Partner Service. |
| Partner | An independent third-party vendor, venue, rental company, yacht operator, wellness provider, travel supplier or other service provider listed on the Platform. |
| Partner Rules | The Partner’s availability, eligibility, security-deposit, cancellation, refund, conduct and service-specific rules made available to you before you confirm and pay for a Booking. |
| Partner Service | A car rental, yacht or marine experience, venue booking, wellness service, professional service, travel package or other experience supplied by a Partner. |
| Platform Fee | Any booking, reservation, concierge, service or administration fee charged by Ananda Hub and disclosed before payment. |
3. Our role as an access and booking platform
Ananda Hub operates a marketplace and commercial brokerage platform that helps Customers discover, request, reserve and pay for Partner Services. Unless a listing expressly states otherwise, the Partner—not Ananda Hub—supplies and performs the Partner Service.
A Booking may involve two linked contracts: (a) your agreement with Ananda Hub for access to and use of the Platform and any disclosed Platform Fee; and (b) your agreement with the relevant Partner for the Partner Service. The identity of the Partner, the applicable Partner Rules and the party receiving payment will be disclosed before confirmation and recorded in the Booking confirmation or receipt.
We are responsible for operating the Platform, accurately presenting information we create, transmitting accepted Booking requests, administering charges we impose and performing any obligation expressly assigned to Ananda Hub. The Partner is responsible for licensing, availability, descriptions it supplies, safety and delivery of the Partner Service. We may assist with communications and disputes, but do not control every independent act or omission of a Partner. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded under UAE law.
4. Eligibility and accounts
- You must be at least 18 years old and legally capable of entering into a contract to create an account or make a Booking. Services involving vehicles, nightlife, alcohol, travel or other regulated activities may have higher or additional eligibility requirements.
- You must provide accurate, current and complete information and keep it updated.
- You are responsible for account security and for activity carried out through your account. Notify us immediately if you suspect unauthorized use.
- You may not impersonate another person, create accounts using false details, transfer your account, or use another person’s identity or payment method without authority.
- We may request identity, age, driving-licence, passport, visa, insurance, payment or other verification reasonably required for a Booking or by law.
5. Listings, requests and booking confirmation
Listings, photographs, descriptions, prices and availability are supplied by Partners or compiled from Partner information. We seek reasonable accuracy but availability and details may change. A request is not confirmed until the Platform, Ananda Hub or the Partner issues a clear confirmation and any required payment or deposit has been received.
You must be able to review the listing, Partner identity, dates, location, number of guests, inclusions, exclusions, eligibility requirements, Partner Rules, cancellation terms, payment recipient and total price before paying. Material terms cannot be changed retroactively without your agreement, except where required by law. Notify us promptly if a confirmation is materially incorrect.
We or a Partner may reject or cancel a request where the service is unavailable, information is incomplete, verification fails, pricing is clearly erroneous, fraud is suspected, or performance would be unlawful or unsafe. If a confirmed Booking is cancelled for one of these reasons, refunds will be handled under section 8.
6. Prices, taxes, payments and authorization
- Prices are displayed in AED unless stated otherwise. The checkout screen will show the amount payable, including any disclosed Platform Fee, Partner charge, deposit and applicable VAT or other taxes.
- Payments are processed through licensed third-party payment providers. Depending on availability, your device, location, Booking type and provider approval, payment methods may include supported payment cards, digital wallets such as Apple Pay or Google Pay, or another payment method displayed at checkout. Ananda Hub does not independently provide payment aggregation, money-transfer or stored-value services. The selected provider’s separate terms and privacy practices apply.
- A payment may also be completed through a secure payment link issued by Ananda Hub, the relevant Partner or a licensed payment provider. You must confirm the recipient, amount, Booking reference and payment-page address before paying, and should not pay through an unverified link.
- Where offered at checkout, eligible Customers may use a buy-now-pay-later or instalment service such as Tabby or Tamara. Availability is not guaranteed and is subject to the provider’s approval, eligibility checks, instalment schedule, fees, late-payment rules, cancellation and refund terms. Any credit or instalment arrangement is between you and that provider unless expressly stated otherwise.
- Mentioning a payment method in these Terms does not mean that it is currently available for every Booking. Only the methods displayed through the official Platform, an authorized Partner channel or a verified payment link may be used.
- By submitting payment details, you confirm that you are authorized to use the selected payment method and authorize the applicable charge, pre-authorization or security-deposit hold.
- Before payment, the checkout and subsequent receipt will identify the amount, payment recipient or merchant of record, Partner charge, Ananda Hub fee, deposit, taxes and refund responsibility applicable to that Booking. Where a marketplace settlement product is used, the regulated payment provider may route or settle funds and calculate the agreed Ananda Hub commission.
- You remain responsible for bank charges, currency conversion, chargebacks made without valid grounds, fines, damage, excess usage, incidentals and other properly disclosed post-service amounts.
We do not generally store full payment-card numbers. Payment providers process card information under their own security standards.
7. Deposits, minimum spend and additional charges
Some services require a reservation deposit, refundable security deposit, card hold, minimum spend or advance payment. The type, amount and refundability will be stated in the listing, checkout, confirmation or Partner Rules. A venue minimum spend may be redeemable only against eligible items and may exclude taxes, service charge, tips or restricted items.
The Partner may charge documented additional amounts for damage, loss, traffic or marine fines, late return, overtime, excess mileage, fuel, cleaning, smoking, no-show, extra guests, prohibited use or other breaches of Partner Rules. Where we facilitate such a charge, we may request supporting evidence and give you a reasonable opportunity to respond, subject to urgent legal or safety needs.
8. Cancellations, changes, no-shows and refunds
The cancellation and refund conditions shown before confirmation apply to the Booking. Partner Services can have different cut-off times and refundability. Unless the Booking states otherwise:
- a cancellation is effective only when submitted through the available cancellation channel and acknowledged by the Platform, Ananda Hub or the Partner;
- a late arrival, no-show, failure to provide required documents, or denial of service caused by failure to meet eligibility or conduct rules may be treated as a Customer cancellation without refund;
- date, guest, vehicle, itinerary or service changes are subject to availability and may change the price;
- once refund entitlement is confirmed, the party identified as responsible for the refund will instruct the original payment provider within seven business days. The customer’s bank or card network may require additional processing time; and
- Platform Fees are refundable only where the checkout terms say so, where Ananda Hub cancels without providing the relevant Platform service, or where required by law.
If a Partner cancels or cannot materially provide the confirmed service, you may choose a reasonably comparable alternative where available or a refund of the amount paid for the affected service. Any Ananda Hub Platform Fee charged solely for that cancelled service will also be refunded unless the cancellation resulted from your breach or the fee lawfully relates to a separately completed service. Nothing limits mandatory consumer remedies.
9. Cars and mobility services
- The driver must meet the rental company’s age, licence, identification, deposit, insurance and driving-history requirements. Approval remains with the Partner.
- Only approved drivers may drive. The Customer must inspect the vehicle, report existing damage, obey UAE traffic laws, and use the vehicle only in permitted areas and for lawful purposes.
- Mileage, fuel, Salik/tolls, parking, traffic fines, impoundment, insurance excess, damage, tyre damage, off-road use, smoking, late return and cross-border rules are determined by the Partner Rules and rental agreement.
- Vehicle make, model, colour or year may be substituted only where permitted by the Booking terms, normally with a reasonably comparable category or a refund option for a material downgrade.
10. Yachts and marine experiences
- The operator and captain control navigation, passenger capacity, safety instructions, boarding, route and whether conditions are safe. Their lawful safety decisions are final.
- Bookings may be changed, delayed or cancelled due to weather, sea conditions, authority restrictions, mechanical issues or safety concerns. The applicable rescheduling or refund terms will be communicated.
- Customers must comply with identification, dress, conduct, prohibited-item, catering, swimming and passenger rules. Costs caused by Customer damage, misconduct or excess time may be charged.
11. Venues, nightlife and hospitality
- Entry remains subject to the venue’s door policy, age and ID checks, dress code, capacity, conduct rules and applicable law. A Booking does not override lawful admission requirements.
- Table location, seating, opening hours, entertainment and menu items may change. Minimum-spend terms and included items are controlled by the confirmed Booking and Partner Rules.
- You and your guests must behave respectfully. A venue may refuse or remove persons for unlawful, unsafe, abusive or disruptive conduct without refund where legally permitted.
12. Travel packages and third-party travel supply
Flights, hotels, villas, transfers, tours and travel packages are contracted, arranged and supplied by an appropriately licensed travel or tourism Partner and its third-party suppliers. The licensed Partner will be identified before payment and is responsible for the travel contract and fulfilment. Ananda Hub acts only as a commercial broker or booking facilitator unless a confirmation expressly and lawfully states otherwise. The Partner’s fare rules, baggage terms, visa and passport requirements, check-in rules, security deposits, local taxes and cancellation conditions apply.
You are responsible for valid passports, visas, insurance, health requirements, entry permissions and compliance with destination laws. Unless expressly included, travel insurance is not included. We strongly recommend appropriate insurance.
13. Wellness and professional services
Information on the Platform is not medical, legal, financial or other regulated professional advice. Customers must assess suitability and disclose relevant allergies, medical conditions or other information directly to the Partner. Regulated services must be delivered by appropriately licensed Partners.
14. Promotions, credits and member offers
Promotions, referral rewards, credits and member offers may have separate validity, eligibility, category, minimum-spend and non-transferability conditions. Unless stated otherwise, they have no cash value, cannot be combined, and may be withdrawn where issued in error, obtained through abuse or prohibited by law.
15. Customer conduct and prohibited use
You must not:
- use the Platform or a Partner Service unlawfully, fraudulently, dangerously or to harm another person;
- circumvent the Platform to avoid disclosed charges after being introduced to a Partner through Ananda Hub;
- scrape, copy, reverse engineer, disrupt, overload, probe or introduce malicious code into the Platform;
- upload unlawful, misleading, infringing, defamatory, obscene or harmful content;
- abuse staff, Partners or other Customers, manipulate reviews, misuse promotions, or make false disputes or chargebacks; or
- use Platform content, data or Partner information for unauthorized commercial solicitation.
16. Reviews, messages and user content
If you submit a review, photograph, message or other content, you retain ownership but grant us a non-exclusive, royalty-free licence to host, reproduce, format and display it only as reasonably necessary to operate and improve the Platform. We will not use your name, image, voice or private message in external advertising without separate, specific consent. You confirm you have the necessary rights and that the content is truthful and lawful. We may moderate or remove unlawful, unsafe or irrelevant content.
17. Intellectual property
The Platform, Ananda Hub name, branding, interface, software, text, graphics and compilation are owned by or licensed to us and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Platform for personal, lawful booking purposes. No other right is granted.
18. Communications and notifications
We may send service communications necessary for your account or Booking by in-app notification, push notification, email, SMS, telephone or messaging channel you provide. Marketing communications require the consent or other lawful basis required by law and can be opted out of; essential booking and security messages cannot be disabled while the relevant service is active.
19. Suspension and termination
You may stop using the Platform and request account deletion. We may restrict, suspend or terminate access where reasonably necessary to protect users, Partners, the Platform or legal compliance; investigate suspected fraud or breach; respond to authority requests; or address non-payment. Where appropriate, we will provide notice and an opportunity to respond. Existing payment, refund, liability and dispute obligations survive termination.
20. Platform availability and third-party links
We aim to keep the Platform available but do not promise uninterrupted or error-free operation. Maintenance, security incidents, network failure, third-party systems, location services or events beyond reasonable control may affect access. Links or integrations operated by third parties are subject to their own terms.
21. Disclaimer and limitation of liability
To the maximum extent permitted by law, Ananda Hub is not responsible for indirect or consequential loss that was not reasonably foreseeable and was caused solely by a Partner’s independent performance of a Partner Service. This does not exclude Ananda Hub’s responsibility for its own Platform, booking, payment, disclosure or refund obligations, or for its fraud, wilful misconduct, gross negligence or breach of a non-excludable duty.
Where liability may lawfully be limited, our aggregate liability relating to a Booking will not exceed the total amount paid for the affected Booking. This limit does not apply to death or personal injury caused by our negligence, fraud, wilful misconduct, gross negligence, breach of confidentiality or data-protection obligations, or any liability that cannot legally be limited. Mandatory UAE consumer rights always prevail.
22. Indemnity
To the extent permitted by law, you will reimburse us for reasonable losses, claims and costs caused by your unlawful use, material breach of these Terms, infringement of third-party rights, or damage caused by you or your guests. This does not apply to the extent the loss was caused by us or a Partner.
23. Force majeure
Neither Ananda Hub nor a Partner is liable for delay or failure caused by events beyond reasonable control, including severe weather, authority action, road or port closure, epidemic, civil disturbance, labour disruption, systems or payment-network failure. The affected party must take reasonable steps to reduce impact. Refund or rescheduling rights remain subject to the confirmed Booking and mandatory law.
24. Complaints and disputes
- Contact us promptly with your Booking number, description of the issue and supporting evidence at info@anandaplatform.com or through Help & Support in the Platform. Customer support is handled electronically; Ananda Hub has no customer-facing retail premises.
- We will acknowledge and review the complaint, coordinate with the Partner where relevant, and seek a fair resolution. You must give us and the Partner a reasonable opportunity to investigate.
- You may also use any competent UAE consumer-protection channel available to you. These Terms do not restrict mandatory complaint or consumer rights.
25. Governing law and jurisdiction
These Terms are governed by the federal laws of the United Arab Emirates and the local laws applicable in the Emirate of Abu Dhabi. Subject to any mandatory consumer forum or jurisdiction, the courts of Abu Dhabi have exclusive jurisdiction. Before filing proceedings, the parties should attempt in good faith to resolve the dispute for at least 30 days after written notice.
26. General provisions
- If a provision is invalid or unenforceable, it will be adjusted or severed to the minimum extent required, and the remaining provisions continue.
- Our failure to enforce a provision is not a waiver. You may not assign your rights without our written consent; we may assign these Terms as part of a lawful restructuring, financing or transfer of the Platform, with appropriate notice where required.
- These Terms must be made available in Arabic and may also be provided in English. Both versions are intended to have the same meaning. If there is a conflict, the Arabic version and mandatory UAE law prevail to the extent required by law.
- These Terms, the Privacy Policy, the confirmed Booking and applicable Partner Rules constitute the agreement concerning the relevant use or Booking.
27. Changes to these Terms
We may update these Terms for legal, security, operational or service changes. We will post the revised version and effective date and provide prominent notice where a change materially affects your rights. Changes do not retroactively alter a confirmed Booking unless required by law or agreed with you.
